PLEASE READ CAREFULLY. THESE TERMS CONTAIN ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT IMPACT YOUR LEGAL RIGHTS. PLEASE REVIEW THESE TERMS CAREFULLY FOR MORE INFORMATION.

These Premise Entry & Parking Terms & Conditions are legal terms (“Terms”). Read them carefully. They apply to the Truman Sports Complex, Arrowhead Stadium, and/or GEHA Field at Arrowhead Stadium, together with their parking areas, and/or its grounds and the surrounds (including, without limitation, entry gates and land outside of the entry gates) (the “Premises”) only when such Premises are under the control of any of the following: Kansas City Chiefs Football Club, Inc. (the “Club”) Arrowhead Events, LLC, Chiefs Ambassador Charitable Foundation, the National Football League (“NFL”), and any partner, affiliate, sponsor or licensee of those entities (individually or collectively, “Management”). These terms apply to any person who is entering the Premises, whether by walking, via ride-share, or any type of vehicle (personal, commercial or otherwise) (each person, including minors accompanying that person, an “Entrant”).

Entry onto the Premises is through a revocable license that grants Entrant a one-time entry into the Premises for a specified event on a specified date (the “Event”) with no right of re-entry. Any Entrant seeking entry to the Event or Premises (regardless if Entrant personally purchased a parking Pass (defined below) or other Event ticket) agrees that: (i) entry, and the  license granted to Entrant, is subject to these Terms, and (ii) by acceptance and/or use of such license or by entrance into the Premises, each Entrant is deemed to have read and understood the Terms, and agreed to be bound by them. Failure to comply with the Terms may result in forfeiture of the license and all rights arising under it without refund and entitle Management to pursue all legal remedies available. Admission may be refused or revoked, and Entrant may be ejected in Management’s sole discretion. Management reserves the right to revoke or restrict your entry into the Premises and/or the Event for any reason with no advance notice. Access to the Premises is only for guests who have a valid ticket to the Event; Management reserves the right to confirm guests have valid tickets to the Event at any time and for any reason.

IF ENTRANT PURCHASED A PASS TO PARK A VEHICLE AT THE PREMISES (A “PARKING PASS”), ENTRANT ACKNOWLEDGES THAT ALL PASS SALES ARE FINAL. NO REFUNDS OR EXCHANGES EXCEPT AS PROVIDED HEREIN. THE SOLE AND EXCLUSIVE REMEDY if admission is refused or revoked, Premise capacity limitations result in Pass cancellation, or the Event is canceled and not rescheduled for any reason, or for any breach of the Terms, is a refund of up to the Pass price set by Management (“Face Value”). IN NO EVENT SHALL ENTRANT BE ENTITLED TO ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF FACE VALUE FOR THE PASS.

ANY DISPUTE, CLAIM, OR CAUSE OF ACTION IN ANY WAY RELATED TO THE PASS OR THE EVENT SHALL BE RESOLVED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION IN KANSAS CITY, MISSOURI ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, REGARDLESS OF WHERE ENTRANT RESIDES OR FROM WHERE THE PASS WITH WHICH ENTRANT SEEKS ADMISSION WAS PURCHASED. ENTRANT AND MANAGEMENT AGREE THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS. ENTRANT UNDERSTANDS, ACKNOWLEDGES AND AGREES THAT THEY ARE WAIVING THEIR RIGHT TO A COURT OR JURY TRIAL AND ANY RIGHT TO LITIGATE OR ARBITRATE ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION. ANY ARBITRATION AWARD SHALL BE LIMITED TO ACTUAL DAMAGES AND ATTORNEYS’ FEES. JURISDICTION FOR ANY FILING OR APPEAL OF AN ARBITRATION AWARD IS APPROPRIATE ONLY IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF MISSOURI. ENTRANT AGREES AND ACKNOWLEDGES THAT ANY DISPUTE, INCLUDING THE FACT AND OUTCOME OF ARBITRATION, IS STRICTLY CONFIDENTIAL. ENTRANT UNDERSTANDS THAT THIS CONTRACT CONTAINS A BINDING ARBITRATION CLAUSE THAT MANAGEMENT OR ENTRANT MAY ENFORCE. IF ENTRANT DOES NOT CONSENT TO THIS CLAUSE, ENTRANT MUST LEAVE OR NOT ENTER THE PREMISES. ABSENT HIS/HER AGREEMENT TO ARBITRATE AND WAIVER OF HIS/HER RIGHT TO A TRIAL BY JURY, MANAGEMENT WOULD NOT PERMIT ENTRANT TO PURCHASE A PASS OR ENTER. THIS CLAUSE IS GOVERNED BY THE FEDERAL ARBITRATION ACT.

The Event date and time (and gate opening time) are subject to change at Management’s sole discretion, and no such change shall entitle Entrant to a refund or other remedy at law or in equity if Entrant cannot attend or for any other reason. Entrant may also be relocated or moved to a different parking lot/space in Management’s sole discretion, and no such relocation shall entitle Entrant to a refund or other remedy if Entrant is relocated to spot or lot of comparable Face Value.

Management reserves the right to deny or revoke the admission of, and to ban from future Events, any person who it determines, in its sole discretion, poses a risk to the health, safety, or enjoyment of other attendees or whose conduct violates these Terms, any Event policies, or is otherwise disorderly (or complicit therein) without refund.

Unauthorized entry into restricted areas, interfering with the progress of the Event, attempting any physical contact with an Event participant, and/or any other disorderly conduct deemed dangerous, inappropriate, or in violation of the Fan Code of Conduct or any other relevant security policies is strictly prohibited. Violators may be removed from the Premises and subject to arrest and prosecution, forfeiture of Pass privileges, and other penalties including up to a lifetime ban. Violators may also be subject to civil penalties and/or fines, as well as financial liability for any damages, costs or injuries incurred as a result of such unauthorized entry or interference. Such conduct constitutes a serious breach of safety and security protocols, and violators assume any and all risks associated therewith, including the risk of personal injury (including death), and the risk of loss or damage to personal property. Entrant must follow the directions of Management personnel at all times and not doing so may result in expulsion from the current Event and may result in prohibition from future events at the Premises.

Entrant agrees not to create, transmit, display, distribute, exploit, misappropriate or sell (or aid in such activity) (1) in any form, any description or account (whether text, data or visual, and including, without limitation, play-by-play data) of the Event or related events (collectively, “Descriptive Data”) for any commercial or non-personal, purpose; (2) any images, videos, audio or other form of display or public performance or reproduction of any portion of the Event or related events (“Works”) for any commercial or non-personal purpose; or (3) livestreams of any portion of the Event or related events (“Livestreams”). Notwithstanding the foregoing, Entrant agrees that by causing their Pass to be scanned upon entry to the Event, Entrant shall be deemed to have signed the Pass and granted Management an exclusive worldwide, irrevocable, perpetual, sub-licensable, royalty-free license to all rights associated with any Works, Livestreams, and Descriptive Data. Entrant grants irrevocable permission to Management, and their respective sponsors, licensees, advertisers, broadcasters, designees, partners and agents to use, publish, distribute and/or modify Entrant’s image, likeness, voice, actions and statements in any medium including, without limitation, audio, video, or images of the Event for any purpose without further authorization or compensation, and waives all claims and potential claims relating to such use unless prohibited by law.

Any collection, use, and/or disclosure of Entrant data in connection with Entrant’s use of the Pass license, attendance at the Event, or use of the websites, mobile applications, and other online or offline services of Management, including without limitation use of the Premises Wi-Fi network, (the “Services”), are subject to the Club Privacy Policy (linked below), which provides greater detail on how Entrant personal information may be used and how to exercise any rights Entrant might have under applicable law. By using the Services, Entrant acknowledges that they have read and understood the terms of the Club’s Privacy Policy.

ENTRANT KNOWINGLY AND VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS incident to the Event and related events, including the risk of personal injury (including death), exposure to communicable diseases, viruses, bacteria or illnesses (including, e.g., COVID-19), or the causes thereof, or lost, stolen or damaged property, whether occurring before, during, or after the Event, however caused, and hereby waives all claims and potential claims relating to such risks, hazards and dangers.

RELEASE, WAIVER & COVENANT NOT TO SUE. On behalf of Entrant and Entrant’s Related Persons, Entrant knowingly and voluntarily releases and covenants not to sue each of the Released Parties with respect to any and all claims that Entrant or any of Entrant’s Related Persons may now have or that hereafter accrue, whether known or unknown, against any of the Released Parties that relate to any of the risks, hazards and dangers described above, or resulting from  anything which has happened up to now, including without limitation any and all claims that arise out of or relate in any way to Entrant’s or any of Entrant’s Related Persons’ entry into, or presence within or around, the Event including without limitation in parking areas or entry gates, or associated with locations near the Premises or field of play, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. ENTRANT UNDERSTANDS THAT ENTRANT IS RELEASING AND WAIVING CERTAIN POTENTIAL RIGHTS HELD BY ENTRANT AND ENTRANT’S RELATED PERSONS. TO THE EXTENT APPLICABLE ENTRANT KNOWINGLY AND VOLUNTARILY WAIVES THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE AS AGAINST EACH RELEASED PARTY WITH REGARD TO CLAIMS RELEASED HEREBY AND ACKNOWLEDGES AND AGREES THAT THIS WAIVER IS AN ESSENTIAL AND MATERIAL PART OF THESE TERMS.  ENTRANT FURTHER ACKNOWLEDGES THE SIGNIFICANCE AND CONSEQUENCE OF THE RELEASE AND THE SPECIFIC WAIVER OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE.

As used herein:

Related Persons” means Entrant’s heirs, assigns, executors, administrators, next of kin, anyone attending the Event with Entrant (which persons Entrant represents have authorized Entrant to act on their behalf for purposes of agreeing to the Terms, including the release herein), and other persons acting or purporting to act on Entrant’s or their behalf.

Management is not responsible for lost, stolen, destroyed, duplicated or counterfeit Passes and may refuse to honor them. Passes may not be used for, or in connection with, any form of commercial purposes including, without limitation, advertising, promotions, contests, sweepstakes, giveaways, gambling or gaming, without the express written consent of Management. Use of Passes in violation of law is strictly prohibited and will result in seizure, revocation and/or forfeiture of the license without refund.

If any provision of this revocable license is determined to be invalid, illegal, or unenforceable, such provision shall be deemed severed and not affect the enforceability of any other provisions, which shall be enforced as if the revocable license did not contain the invalid, illegal, or unenforceable provision. Passes are subject to sales tax, unless exempt by operation of law.

All applicable federal, state, and local laws shall apply and will be strictly enforced by police and/or Management. Entrant shall obey all instructions, directions and requests of Management’s staff, all Premise signage, and all of Management’s rules and regulations.

Entrant agrees that Management (or a third party on behalf of Management) may send text (SMS) messages relating to the Event to Entrant’s phone number provided to Management, including through the use of automated dialer technology. To opt out, Entrant must either (i) email fanexperience@chiefs.com with subject line “Text Message Opt Out” and include the phone number within the body of the email; or (ii) comply with any opt-out instructions provided to Entrant from or on behalf of Management via text message from time to time.

The failure by Management to enforce any one or more terms of these Terms, or any policies or regulations of Management’s, shall not serve as a waiver with respect to any such terms, conditions, policies or regulations for any future enforcement of these Terms or other Events. Nothing contained herein shall be construed to create any duty or obligation of Management to create, enforce, guarantee, or monitor any regulations, policies, procedures, or situations related to the Event or Entrant’s use of a Parking Pass at the Premises.

These Terms shall be governed exclusively by the provisions hereof and by the laws of the state of Missouri and is intended to be as broad and inclusive as permitted by such laws, without giving effect to any choice of laws or conflict of law rules (whether of Missouri or any other jurisdiction) which would limit the application of the laws or of the jurisdiction of the laws of the state of Missouri.

ENTRANT ACKNOWLEDGES THAT ENTRANT HAS READ AND UNDERSTANDS THESE TERMS AND THAT ENTRANT IS VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE MANAGEMENT PARTIES.

Entrant may not possess or have under Entrant’s control or within Entrant’s property any Weapon at the Premises. A "Weapon" includes, but is not limited to, any gun, firearm, taser, explosive, incendiary device, knife, dagger, dirk, blade, or other similar object capable of causing physical injury. Management reserves the right to determine in real time whether an object is a Weapon. Any Entrant who violates this prohibition will be removed from the Premises and may be subject to arrest and prosecution, forfeiture of current and future ticket privileges at the Premises and/or other Management events, and other penalties.

Entrant must comply with all Event policies including, without limitation, policies addressing security and fan conduct, health and safety, and bags, including, but not limited to those linked to below.
